These Terms of Service ("Terms") are an agreement between you and Sellerank LLC ("Sellerank", "we", "us"). They apply when you visit our website, request an analysis or call, or buy any of our services. By using our website or services you agree to these Terms.
1. Our services
Sellerank helps local businesses get more quote requests and paying customers. Services may include:
- Business analysis and competitor comparison
- Growth roadmaps
- Websites and quote forms
- Missed-call text back, review requests and follow-up automation
- Google Business Profile and Maps optimization
- AI receptionists that answer calls and chat on your website
The exact scope of paid work is described in your package or written proposal.
2. No guaranteed results
Any revenue, call, ranking or review figures we show are estimates and examples based on assumptions. They are not promises. Results depend on your market, competitors, pricing, service quality and many factors outside our control. Google and other platforms decide rankings on their own.
3. Free analysis
Our free analysis and roadmap call carry no obligation. We use public information about your business, such as your Google listing, reviews and website, to prepare it.
4. Fees, billing and cancellation
Paid packages may include a one-time setup fee and a monthly fee, as shown on our pricing page or your proposal. Monthly fees are billed in advance and continue until cancelled.
You may cancel a monthly plan with written notice to Contact@sellerank.com; cancellation takes effect at the end of the current billing period. Setup fees cover work already started and are non-refundable once work begins, unless we agree otherwise in writing. Third-party costs (phone numbers, call minutes, domains, ad spend) are billed as agreed and are not refundable.
5. Your responsibilities
- Give us accurate business information, including services, hours, prices and service areas.
- Only provide logos, photos and content you have the right to use.
- Review the website, AI receptionist settings and messages we set up for you, and tell us about anything incorrect.
- Follow the laws that apply to contacting your customers, including the Telephone Consumer Protection Act (TCPA), do-not-call rules, and text messaging consent rules. You are responsible for having consent to contact your customers.
6. AI receptionist and calls
AI receptionists use automated voice and language technology. They can misunderstand callers or give incomplete answers, so they should not be relied on for emergencies, legal, medical or safety advice. Calls and chats handled by the receptionist, and sales calls we make, may be recorded and transcribed to provide and improve the service. You agree to give any notice to your callers that local law requires, and we configure a recording notice where needed.
7. Websites and content ownership
You keep ownership of your business name, logo and content. Once your setup fees are paid, the website content we build for you is yours to use. We keep ownership of our templates, software, systems and know-how. Sample websites we build to show what is possible remain ours until a client agreement is signed.
8. Third-party services
Our services rely on providers such as Google, ElevenLabs, Twilio and hosting and AI providers. Their availability and terms are outside our control, and we are not responsible for their outages or changes.
9. Acceptable use
You may not use our services for unlawful, misleading or harmful activity, spam, harassment, or to collect data you are not allowed to collect. We may suspend services that are used this way.
10. Disclaimers
Our services are provided "as is" and "as available". To the extent the law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
11. Limitation of liability
To the extent the law allows, Sellerank is not liable for indirect, incidental or consequential damages, or for lost profits, lost jobs or lost data. Our total liability for any claim is limited to the amount you paid us in the three months before the claim.
12. Termination
Either party may end paid services as described above. We may end or suspend services if you do not pay or break these Terms. Sections that by their nature should continue (fees owed, ownership, disclaimers, liability) survive termination.
13. Governing law
These Terms are governed by the laws of the State of Wyoming, USA. Any dispute will be handled in the state or federal courts located in Wyoming, unless the law requires otherwise.
14. Changes and contact
